People of California et al v. Qwick, Inc.

People of California et al. v. Qwick, Inc.,

San Francisco Superior Court

Case No. CGC-23-608756

The Notice is to alert you that you were due two payments in the case of People of California et al. v. Qwick, Inc., San Francisco Superior Court Case No. CGC-23-608756 (“the Lawsuit”) and, according to records that were provided to our office, you did not receive one or both of these payments. Under the terms of the Judgment, no further efforts are required to provide restitution to you. But the San Francisco City Attorney’s Office has hired our office, Atticus Administration, to make a final effort to locate and pay you.

The San Francisco City Attorney filed the Lawsuit on behalf of the People of California and the City and County of San Francisco (“Plaintiffs”) alleging that Qwick, Inc. misclassified California shift workers like you as independent contractors instead of employees and thereby denied shift workers employment protections from August 31, 2019 through February 29, 2024 (“the Relevant Time Period”). While Qwick, Inc. denied that you were misclassified, Qwick, Inc. agreed to the entry of a court judgment that requires it to reclassify its California shift workers as employees and to make restitution payments to shift workers who performed work using the Qwick App in California during the Relevant Time Period.  These payments were sent to Affected Workers in 2024 and 2025. You are receiving the Notice because you did not cash one or both of these payments.
